We are from Canada & one week ago signed a timeshare contract in SC. High pressure sales. Can we cancel now?
We shouldn’t have signed. Got ‘caught up in the moment’. I have big health issues — won’t likely live to use many of the 40 years we purchased. We were told we could borrow from future years to gain additional weeks now, or leave unused portion to our kids. After we signed I went on-line and found many complaints against this company and I’ve learned some disturbing facts about timeshare that no-one told us before. For example, I didn’t realize the company could raise our mgmt fees at any time or add extra “assessments”. Judging from what I’ve leanred on-line, I now see that the mgmt. company holds all the cards when it comes to allocating weeks and exchange properties. All in all, I’m feeling awful for being manipulated by high pressure salesmen and I know I’ve put my family finances in jeopardy for no good reason. Is there a cooling off period for such contracts in SC? How do I get out of this? We’re in SC for one more week. Should we see a lawyer here or is it already too late?
Somewhere in the fine print it will say “the parties agree to be bound by the laws of ………..” (presumably, but not necessarily SC) The worst they can do is get a judgment against you – which couldn’t possibly be enforced in Canada – and in all likelihood would only be enforceable in SC or whatever state is named as above. It would cost them way more than it’s worth to even try to sue you in Canada, but they might try to damage your credit rating. As long as you don’t want to get a major loan or mortgage for the next few years, then even that wouldn’t amount to much. If you are returning to Canada and won’t be available, a lawyer will probably hose you for whatever he can get. So as long as the contract is only enforceable in a single state (almost 100% likely as I’ve outlined above) then as long as you stay out of that state in the future, you aren’t likely to ever have a problem (apart from possible harrassing and threatening phone calls that is).
And as a point of interest, if you have serious health issues and you’re not in the habit of reading fine print, you’d probably be even more horrified if you read the limitations and exclusions on whatever health insurance you carry as a Canadian in the United States. A Canadian who is hospitalised due to a serious illness in the US is risking bankruptcy in a very short time. Good luck.
